The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

The petitioner is husband of the victim of dowry death. The marriage was solemnized in the year 2005 whereas the victim died in the year 2018 leaving behind two sons. Allegation is of demand of dowry and torture for the same after birth of the two children.

Learned counsel for the petitioner submits that just after death of the victim just to pressurize false case has been lodged. Petitioner is in custody since 18.11.2019. Other co-

Patna High Court CR. MISC. No.26090 of 2020(4) dt.05-01-2021 2/2 accused have already been allowed bail by different co-ordinate Benches of this Court.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.34 of 2019, arising out of Ahiyapur P.S. Case No.916 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
