2. The petitioner seeks bail in connection with Angarh P.S. Case No. 17 of 2024 registered for the offence under Sections 395 of the I.P.C.
3. The petitioner is not named in the F.I.R. and is in custody since 09.12.2024.
4. The allegation against the petitioner is to commit dacoity along with other co-accused persons while committing so looted cash of rupees forty thousand, ten grams of gold and two earing from the house of informant.
5. Learned counsel appearing for petitioner submitted that the name of petitioner transpired on the basis

No.25245 of 2025(3) dt.28-07-2025 2/3 of confessional statement of apprehended co-accused namely, Sayem Babu, in furtherance of which no incriminating materials recovered/ surfaced during course of investigation. It is pointed out that said co-accused Sayem Babu has already been granted bail by one of the learned Coordinate Bench of this Court through Cr. Misc. No. 34327 of 2025 vide its order dated 03.06.2025. It is submitted that petitioner was not put on TIP as yet. While concluding the argument, it is submitted that petitioner found involved in two more criminal cases of similar nature, subsequent to this case, where he appears implicated on the basis of suspicion arising out of present case, where in one of the case petitioner is on bail and moreover, investigation of this case is already completed, as such, there is no chance of tampering with the evidence.
6. Learned APP opposes the prayer of bail.
7. In view of aforesaid factual submissions and by taking note of fact as save and except suspicions nothing prima-facie appears incriminating against this petitioner, coupled with fact that investigation has already been

No.25245 of 2025(3) dt.28-07-2025 3/3 completed where petitioner is in custody since 09.12.2024, accordingly petitioner above named, is directed to be released on bail in connection with Angarh P.S. Case No. 17 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea/concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/ Section 480(3) of BNSS.
