JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends arrest in connection with Bakhtiyarpur P.S. Case No. 493of 2015 registered under Sections 7 of the Essential Commodities Act.

Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused persons have been granted bail by this Court vide orders dated 17.02.2016, 12.04.2016, 26.04.2016, 19.04.2016 and 19.05.2016 passed in Cr. Misc. Nos. 7124 of 2016, 15165 of 2016, 17232 of 2016, 16739 of 2016 and 20752 of 2016 respectively. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of

Patna High Court Cr.Misc. No.26835 of 2017 (2) dt.18-07-2017 the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 493of 2015 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
