JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 30-09-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Since the physical court proceeding is non-functional, due to present pandemic, COVID-19, the matter is listed with defects.

Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within three weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. This application has been filed for modification of the order dated 03.03.2020 passed in Cr. Misc. No. 10113 of 2020 for extension of time for surrender.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.25643 of 2020(2) dt.30-09-2020 2/2 petitioner has been granted bail vide order dated 03.03.2020 passed in Cr. Misc. No. 10113 of 2020, but during the lockdown period, the petitioner could not surrender within the stipulated period.

Considering the same, let the period of surrender of the petitioner be extended by six weeks from today, in connection with Basantpur P.S. Case No.18 of 2020 to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Judge, Excise, Siwan.

Rest of the condition as stipulated in the order dated 03.03.2020 shall remain as it is.
