1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Ghoshi (Okari O.P.) P.S. Case No. 169 of 2017 dated 14.07.2017 registered under Sections 366, 494 of the I.P.C.
3. As per the prosecution the daughter of the informant namely Soni Kumari went to temple for worship where the informant's co-villager Pankaj Kumar kidnapped his daughter for the purpose of marriage.
4. Learned counsel for the petitioner submits that petitioner is not named in the first information report and he has been made accused on the basis of statement of the victim girl recorded u/s 164 Cr.P.C. He further submits that Pankaj Kumar who was already married solemnized marriage with the victim girl and has been residing with her. In the statement recorded u/s 164
Patna High Court CR. MISC. No.25752 of 2025(2) dt.07-05-2025 2/3 Cr.P.C. the victim girl disclosed the name of three persons namely the petitioner, Chhotan Prasad and Vicky Kumar. Chhotan Prasad and Vicky Kumar has been granted anticipatory bail by co-ordinate bench of this court in Cr. Misc. No. 66482 of 2023 (Annexure 3). The co-accused / Pankaj Kumar has also been granted anticipatory bail by this court in Cr. Misc. No. 63637 / 2018. The bail application of the petitioner along with other two accused persons namely Chhotan Prasad and Vicky Kumar was jointly rejected by learned 1st Additional Sessions Judge, Jehanabad on 09.08.2023 by a common order however the other two accused persons approached this court for grant of anticipatory bail in 2023 but the petitioner due to some urgency went to Ludhiana for earning his livelihood therefore he could not file application for anticipatory bail at that point of time.
5. Regard being had to the submission made by the parties, taking into consideration the fact that similarly accused persons have been granted anticipatory bail by a co-ordinate bench of this court, accordingly I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on

No.25752 of 2025(2) dt.07-05-2025 3/3 furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in connection with Ghoshi (Okari O.P.)
