The petitioner seeks bail in Aurai P.S. Case No. 221 of 2018, instituted for the offence under Section(s) 25(1B)a, 26 and 35 of the Arms Act. As per seizure list one double barrel gun and 27 live cartridges kept in a plastic bag over the wooden Machan have been recovered from thatched house of this petitioner. Counsel for the petitioner submits that no recovery has been made from conscious possession of the petitioner. The house from which the double barrel gun and cartridges have been recovered, does not belong exclusively to this petitioner. He further submits that petitioner is in custody since 27.9.2018 having clean antecedent.

Patna High Court Cr.Misc. No.80235 of 2018(2) dt.01-02-2019 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Aurai P.S. Case No. 221 of 2018, in connection with Aurai P.S. Case No. 221 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
