JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2017 The present application has been filed for modification of the order dated 20.05.2011 passed in Cr. Misc. No. 15952 of 2011 to the extent of extending the period of surrender.

The petitioner along with one Rajesh Singh @ Rajesh Kumar Singh were granted anticipatory bail in connection with Aurangabad(Nagar) P.S. Case No. 287 of 2009 registered under Sections 406, 420/34 of the Indian Penal Code and Section 3(1)(X) of the SC & ST (Prevention of Atrocities) Act.

It is submitted by learned counsel for the petitioner that due to some compelling circumstances the petitioner could not surrender within the stipulated period of time.

This Court is not inclined to modify the order dated 20.05.2011 after more than five years. However, since

Patna High Court Cr.Misc. No.33736 of 2016 (2) dt.11-01-2017 2/2 the petitioner was granted anticipatory bail on merits, it is expected from learned Court below to consider the prayer for bail of the petitioner, preferably on the same day, if the petitioner surrenders within a period of six weeks in connection with Aurangabad(Nagar) P.S. Case No. 287 of 2009. Accordingly the modification application is disposed of.
