JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 1607 of 2018, arising out of Tarari P.S. Case No. 141 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
Allegation is of recovery of 274 litres of liquor from the truck and petitioner is owner of the truck. Submission of learned counsel for the petitioner is that the seizure list shows that the recovery has been made from the truck and Khalasi disclosed the name of the petitioner as owner of the truck.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant
Patna High Court Cr.Misc. No.79122 of 2018(3) dt.14-02-2019 2/2 privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
With the above observation, this application is dismissed.
