Petitioners seek pre-arrest bail in Kusheshwar Sthan P.S.Case No.49/17 registered under Sections 147, 341, 323, 307, 379 and 504 of I.P.C.
Allegation is that petitioner no.1 gave farsa blow on the informant causing injury on his head and hand and petitioner no.2 gave rod blow on the informant causing injury. Submission on behalf of the learned counsel for the petitioners is that there is land dispute between the parties for which title suit is going on and the injuries are simple in nature which will appear from Annexure-3.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.1361 of 2019(2) dt.18-01-2019 2/2 circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of S.D.J.M., Biraul, Darbhanga, in Kusheshwar Asthan P.S.Case No.49 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that the bailors must be of local having sufficient movable and immovable properties within the jurisdiction of the court concerned.
