The petitioner is in custody in connection with Barauni P.S. Case No. 108 of 2019 for the offence under Section 30 (a) and 38 (1) of the Bihar Prohibition and Excise Act 2016. Learned counsel appearing on behalf of the petitioner submits petitioner has no criminal antecedent. He further submits that in the instant case total 110.565 liters was seized. Learned counsel for the petitioner submits that petitioner is not involved in the trade of liquor. Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner.
