The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 379, 34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged by the F.I.R named accused persons including the petitioner that they assaulted the son of the informant by means of lathi, danda. It is specifically alleged against co-accused Vijay Bahardar that he shot fire upon the son of the informant who subsequently succumbed to the injuries.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.33485 of 2021(3) dt.09-03-2022 2/2 petitioner that petitioner has falsely been implicated in this case. The specific accusation of shot fire to the victim is against co-accused Vijay Bahardar. The postmortem report also suggests only one firearm injury.

Considering the aforesaid facts and the criminal antecedents of the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.

The petitioner is directed to surrender before learned Court below within a period of four weeks from today, when it is expected from the learned Court below to consider the prayer for bail of the petitioner, keeping in view the facts discussed above and without being prejudiced by the order of this Court.
