2. Petitioner seeks regular bail in connection with Sarmera P.S. Case No. 226 of 2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 40 litres of illicit country made liquor was recovered from seized motorcycle.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case merely on the basis of suspicion. Petitioner is neither owner nor driver of the vehicle in question. No incriminating article has been recovered from the conscious possession of the petitioner and petitioner has no concern with the alleged recovery. Petitioner is
Patna High Court CR. MISC. No.25600 of 2025(2) dt.27-06-2025 2/2 in custody since 01.02.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application and submits that petitioner carries seven criminal antecedents, out of which four are of similar nature.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional District and Sessions Judge-cum-Exclusive Special Excise Court-II, Biharsharif at Nalanda, in connection with Sarmera P.S. Case No. 226 of 2024.
