Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 457 and 380 of the Indian Penal Code, registered in connection with Khaira (Nagra) P.S.Case No. 370 of 2020.

It is a case of motor-cycle theft.

The learned counsel for the petitioner has submitted that the petitioner is not named in the FIR. His name has figured in the confessional statement of co-accused Ankit Kumar, who has disclosed the name of the petitioner. Except the confessional statement of co-accused, there is no evidence against the petitioner. He has submitted further that co-accused Ankit Kumar and the present petitioner are co-villagers and in

Patna High Court CR. MISC. No.33616 of 2021(2) dt.05-04-2022 2/2 paragraph 11 of the bail petition it has been mentioned that there is enmity between Ankit Kumar and the family members of the present petitioner. He has also submitted that the petitioner is a person of clean antecedents.

Considering the above facts and circumstances, specially the clean antecedents of the petitioner, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran in connection with Khaira (Nagra) P.S.Case No.370 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
