2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 76, 303 , 109, 117 ( 2 ) and 305 of BNS.
3 . As per the prosecution case , petitioner is alleged to have assaulted and outraged the modesty of informant.
4. It is submitted on behalf of the petitioner that from bare perusal of complaint petition , it is apparent that both parties are close agnates. Complainant's husband's grandfather and petitioner are siblings. Complainant is wife of grandson of petitioner. It is further submitted that due to petty dispute , a
Patna High Court CR. MISC. No.22271 of 2025(2) dt.28-04-2025 2/2 scuffle took place between the parties. Injury allegedly caused by this petitioner is simple in nature . Rest of the allegations are ornamental in nature . Petitioner is 85 years old and claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Saran at Chapra in connection with Taraiya P.S. Case No. 475 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
