2. The petitioner apprehends his arrest for the offence alleged under Section 406 of the Indian Penal Code registered in connection with Complaint Case No 604 (C) of 2012.

3. It is submitted that the petitioner has been falsely implicated owing to past enmity between the complainant, who is the Mukhiya and the petitioner being a Ward Member of Gram Panchayat Chilhari, P.S. Dumraon, District Buxar. In any event, the petitioner in his letter dated 18.10.2013 has offered to deposit the amount in question, namely, Rs. 13,500/- with the District Programme Officer, MNREGA, Dumraon, Buxar.

4. Having regard to the entirety of the facts and

No.47479 of 2015 (2) dt.03-11-2015 2/2 circumstances of the case, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Complaint case No. 604 (C) of 2012, subject to the conditions as laid down under Section 438 (2) Cr.P.C., and also subject to the further condition that the petitioner shall deposit an amount of Rs.13,500/- in the court below which shall be subject to final decision of the case.
