The petitioner seeks bail in a case instituted for the offences under Sections 279, 337, 338, 308, 304(II) of the Indian Penal Code.
Prosecution case, in short, is that son of informant in an accident in which auto was hit by a truck. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.2.2019 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to be truck driver. An accident is alleged to have taken place on road with the tempo. The deceaseds happened to be driver and
Patna High Court CR. MISC. No.22037 of 2019(6) dt.03-07-2019 2/2 passenger of the tempo. Due to accident, they succumbed to the injuries. At best, it is a case for an offence under section 304A IPC.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Miss Nutan Kumari, J.M. 1st Class, Danapur, Patna in connection with Maner P.S. Case No. 183 of 2018.
