JUSTICE HEMANT GUPTA ORAL ORDER 05-10-2016 The present is an application for grant of bail under Section 438 of the Code of Criminal Procedure to the petitioner in respect of Sour Bazar P.S. Case No.534 of 2014 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

The allegation against the petitioner is that he obtained signature of the informant in respect of delivery of 15,000 quintals of paddy, but actually 5,000 quintals of paddy were given and that remaining 10,000 quintals of paddy were not delivered. In spite of repeated request, the said quantity of paddy has not been delivered.

After hearing learned counsel for the parties and keeping in view the allegation against the petitioner and the

Patna High Court Cr.Misc. No.28126 of 2016 (3) dt.05-10-2016 2/2 fact that the matter is required to be investigated in respect of forgery on challans and other documents, I do not find that it is a fit case for grant of anticipatory bail to the petitioner.
