Heard the parties.
The petitioners are languishing in custody for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
According to F.I.R., for some dispute arisen out of mending of mobile phone, all the F.I.R. named accused persons including the petitioners entered into the house of the informant and started indiscriminate firing. There is specific allegation against other co-accused that firing made by them caused injury
Patna High Court CR. MISC. No.21659 of 2020(3) dt.03-09-2020 2/2 to respective persons. Petitioners are in custody since 25.02.2020. Investigation of the case is already complete. Considering the nature of material against the petitioners aforesaid and completion of investigation as well as considering the fact that there is no material to substantiate that the petitioners are going to tamper with the evidence, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Mansi P.S. Case No. 251 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
(c) The petitioners shall not leave the country without permission of the trial Court.
