The petitioners apprehend their arrest in a case under Sections 147, 148, 149, 341, 323, 324, 337, 338, 332, 333, 307, 353, 427, 504, 506 and 120B of the Indian Penal Code. Over the burial of the deceased in the graveyard, there was free fight between the two villagers. The allegation of causing grievous injury on the head of the informant is against Hazrat Mian. Petitioner no.1, Ali Hussain, is said to have assaulted with Fattha on thigh of the informant. There is no specific allegation against petitioner no.2. Learned counsel for the petitioner submits that some of the co-accused have already been granted anticipatory bail. He
Patna High Court Cr.Misc. No.25795 of 2016 (2) dt.15-07-2016 2/2 further submits that this is another case with respect to the same occurrence. He next submits that Laxmi Narayan Mahto (informant) has not sustained any injury either on eye and or on others parts of the body, except temporal occipital area. In the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the abovenamed petitioners be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case no. 37 of 2016 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
