2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 394, 302 and 34 of the Indian Penal Code and 27 of the Arms Act.

3. The allegation against the petitioner is to commit murder of uncle of informant and while committing robbery, also took away cash of Rs. 1,50,000/- (Rupees One Lakh Fifty Thousand) which was collected by the injured/deceased on behalf of company.

4. It is submitted that petitioner is not named in the F.I.R. His name surfaced during the course of investigation . Nothing has been recovered from the possession of the petitioner. Specific accusation of assault is against other co-

5. Learned counsel for the State opposes the prayer for bail and submits that in para 43 of the case diary, in the dying declaration, the deceased has named this petitioner as one who fired upon him and also snatched cash of Rs. 1,50,000 /- from him.

6. Considering the dying declaration of deceased recorded in para 43 of the case diary and gravity of allegation, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Kaushik/- U T
