2.The petitioner is named in the complaint petition and apprehending his arrest in connection with Complaint Case No. 9288(c) of 2023 registered for the offences punishable under Sections 498(A), 406 and 506 of the Indian Penal Code.

3. As per the complaint case petitioner, who is husband alleged to commit mental and physical cruelty upon complainant along with family members due to non-fulfillment of demand of dowry

It is submitted by learned counsel appearing on behalf of the petitioner that complainant is not desirous to continue marriage with this petitioner, therefore, present false complaint case was lodged. Taking reference of para 11 of the complaint petition, which is on affidavit, it is pointed out that

No.26759 of 2026(2) dt.27-04-2026 2/2 allegation qua committing mental and physical cruelty is appearing very much general and omnibus in nature against family members including this petitioner. While concluding arguments, it is submitted that above named petitioner is a man of clean antecedent.

5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of para 11 of the complaint petition, which primafacie suggests very general and omnibus allegation qua committing mental and physical cruelty against petitioner, who is the husband, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Patna/concerned Court, where the case is pending in connection with Complaint Case No. 9288(c) of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/ Section 482(2) of BNSS.
