JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-03-2023 The present writ petition has been filed seeking the following relief:- "1. That this application is being filed for issuance of appropriate writ, order/orders, direction quashing the letter dated 22.01.2015 contained as Annexure-5 to this writ application passed by under Secretary to the Government of India Ministry of Home Affairs respondent No.3 whereby and whereunder SSS family pension to
Patna High Court CWJC No.15936 of 2015(2) dt.24-03-2023 2/2 the petitioner's mother late Shyama Devi wife of late Shri Sharwan Sah (PPO No. Sc 17523 Pol) has been cancelled and also passed order to recover the entire amount of pension paid to Smt. Shyama Devi on a baseless ground as to whether her husband's SSS pension had been stopped or not at any time during his life time although It was not stopped at any time. And also for a direction to the respondents to pay her SSS Family Pension which had not been given since October, 2014 to 22.8.2015. And also for a direction to the respondents to pay her back dues of SSS family pension since 1.04.1987 to 12.06.2000 as dues amount i.e, Rs. 2,31,819/- has already been Calculated by treasury officer sent it for payment by his letter No. 1243 dated 29.04.2008."
At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Respondent authorities for redressal of his aforesaid grievances. Liberty, so sought, is granted.
