15-10-2015 Heard Sri Anirudh Kumar Verma, learned counsel for petitioners and learned Addl. Public Prosecutor. Two petitioners, who are mother-in-law and father-inlaw of the deceased, apprehending their arrest in Barauli P.S. Case No. 29 of 2015 registered for the offence under Sections 304(B)/34 of the Indian Penal Code, have prayed for grant of anticipatory bail.

Learned counsel for petitioners submits that there is general and omnibus allegation. Moreover, he has argued that number of other accused persons have been extended the privilege of anticipatory bail.

It was a case of death by strangulation and F.I.R. was lodged under Section 304(B) of the I.P.C. Alongwith the F.I.R.,

Patna High Court Cr.Misc. No.47665 of 2015 (2) dt.15-10-2015 2/2 inquest report has been brought on record, which also suggests that it was a case of death by strangulation. I do not find any ground for extending the privilege of anticipatory bail.

The petition stands dismissed.

It goes without saying that if petitioners surrender and make a prayer for regular bail before the court below within a period of eight weeks from today, the learned court below, without being prejudiced with this order, may examine the same and pass appropriate order in accordance with law.
