ANJANA MISHRA ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is mother-in-law of the deceased, who is apprehending her arrest in connection with Banka P.S. Case No. 140 of 2016 for the offences registered under Sections 304(B)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that husband of the deceased lady is in custody. It is further submitted that similarly situated co-accused persons have been extended the privilege of anticipatory bail vide order dated 21.11.2016 passed in Cr. Misc. No. 29668 of 2016. Considering the aforesaid facts and circumstances of the

No.27594 of 2017 (2) dt.06-07-2017 case, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 140 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
