JUSTICE ARUN KUMAR ORAL ORDER 06-02-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with a case registered under Sections 147, 148, 149, 341, 323, 379, 307 and 506 of the Indian Penal Code.
Allegation in brief is that the informant was returning back with Rs.40,000/- and was intercepted on the way and the accused persons stopped him, abused, assaulted and petitioner no.1 shot at him but he escaped and thereafter, assaulted with lathi and iron rod and snatched away Rs.40,000/-.
Learned counsel appearing on behalf of the petitioners submits that the petitioners are business partners and due to some
Patna High Court Cr.Misc. No.31500 of 2016 (4) dt.06-02-2017 2/2 business dispute, they have falsely been implicated in this case and further submits that except one criminal case against petitioner no.1, there is no other case.
Considering the nature of allegation and the fact that the petitioner no.1 has got criminal antecedent of criminal offence under Section 302 of the I.P.C. so I am not inclined to admit the petitioners on anticipatory bail so their prayer for anticipatory bail is rejected in connection with Salimpur P.S. Case No.146 of 2015 pending in the court of Sri Deepak Kumar, Judicial Magistrate 1st Class, Barh. The petitioners, if so advised, may surrender before the court below and pray for regular bail and the same shall be considered on merit without being prejudiced by this order.
