ANJANA MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners apprehend their arrest in connection with Itrahi P.S. Case No. 63 of 2017 for the offences registered under Sections 147, 148, 149, 341, 323, 504, 506 342, 332, 353, 336, 290, 186, 187, 189, 427 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation against the petitioners is that they had assembled and illegally blocked the road and had attacked the Fire Brigade and caused harm. The said Fire Brigade was alleged to have hit a person which led to the crowd assemble for taking vengeance from the said vehicle. It is further submitted that the allegation against this petitioners is that they have attacked the
Patna High Court Cr.Misc. No.27496 of 2017 (2) dt.13-07-2017 vehicle and have also indulged in other acts of vandalism. It is further submitted that the allegations are wholly frivolous and misconceived and save and except they are part of the crowd there is nothing to show that they had indulged in the acts of vandalism. Considering the aforesaid facts and circumstances of the case, and that the petitioners have no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., 2nd Buxar in connection with Itarhi P.S. Case No. 63 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
