The petitioners seek anticipatory bail in connection with Agiaon (Garhani) P.S.Case No. 137 of 2018, registered for offences punishable under Sections 302/34 of the Indian Penal Code.
As per F.I.R., allegation against the petitioners, who happens to be the cousin father-in-law and cousin mother-inlaw of deceased, is of dowry death. Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the petitioners and from the postmortem report, it is apparent that no sign of injury at the person of deceased and the petitioners
Patna High Court CR. MISC. No.22654 of 2019(2) dt.09-04-2019 2/2 were not residing with the husband of the deceased and they have no criminal antecedents.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand)each with two sureties of the like amount each in connection with Agiaon (Garhani) P.S.Case No. 137 of 2018 to the satisfaction of the learned A.C.J.M.- VII, Bhojpur at Ara, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
