This application for anticipatory bail arises out of Baghaila P.S. Case No. 60 of 2018, disclosing the offence under Section 304-B/34 of the Indian Penal Code.

The petitioner is the mother-in-law of the deceased. Learned Additional Public Prosecution has not been able to point out any material collected in course of investigation, over and above what has been alleged in the FIR in respect of demand of dowry.

Learned counsel, appearing on behalf of the petitioner, has submitted that the message received by the father of the deceased is the basis for making out an allegation that there was a demand of dowry, soon before the death of the

Patna High Court CR. MISC. No.80206 of 2018(7) dt.07-08-2019 2/2 deceased. He has also submitted that if allowed anticipatory bail, there is no chance of the petitioner fleeing from the course of investigation of trial.

Considering the above, this application is allowed. Let the petitioner, above named, in the event of her arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned ACJM, Rohtas at Sasaram in connection with Baghaila P.S. Case No. 60 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
