JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-08-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Chanpatia P.S. Case No. 418 of 2019 for offences under Section 30(a/56) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners have no criminal antecedents. In the instant, 12.975 litres of Nepali liquor was seized from different places including from the joint family house and not from conscious and exclusive possession of the petitioner.

Considering the fact that the petitioners have no criminal antecedents, the Court is inclined to grant bail to them

Patna High Court CR. MISC. No.21661 of 2020(2) dt.14-08-2020 2/2 subject to the condition that the petitioners have to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, petitioners, above-named, in the event of arrest or surrender within one month from today, shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge Excise Act, Bettiah, West Champaran in connection with Chanpatia P.S. Case No. 418 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
