For the Petitioner/s :
Mr.Gajendra Prasad Yadav For the Opposite Party/s :
Mr.Pradeep Narain Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-07-2023 Heard the learned counsel for the petitioner as well as the learned counsel for the informant.
The petitioner apprehends his arrest in connection with Hasanpur P.S. Case No. 197 of 2022, registered for the offences punishable under Sections 341, 323, 504, 506, 354 (B)/34 of the Indian Penal Code.
The petitioner was an accused in Hasanpur P.S. Case No. 115 of 2022 for the offence of outraging the modesty of the daughter of the informant. He was imprisoned in that case and when he was released, as per allegation, he came to the house of the informant and misbehaved with his family members and when the informant side tried to record that episode in mobile, he attempted to snatch it way from the hand of the informant.
Patna High Court CR. MISC. No.26208 of 2023(2) dt.12-07-2023 2/2 The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated. On the other hand, the learned counsel for the informant has submitted that the petitioner is tempering with the evidence of that case and he is making pressure upon the informant side to withdraw the earlier case lodged by them.
In my view, the petitioner does not deserve the privilege of anticipatory bail. Accordingly, it is rejected. The petitioner is directed to surrender before the court below and make a prayer for regular bail.
