====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 Heard learned counsel for the petitioners and learned A.P.P.

The petitioners seek anticipatory bail in connection with Bidupur P.S.Case No. 157 of 2018, registered for offences punishable under Sections 147, 447, 341, 323, 324, 325, 379, 354, 504 and 506 of the Indian Penal Code.

Allegation against the petitioners is of assault the informant with sword with intention to kill the informant, causing injury and snatched her golden chain and also assaulted her father-in-law, Sukhdeo Prasad. Submission of the learned counsel for the petitioners is that there is a case and counter case between the parties though, it is alleged that they were assaulted by sword

Patna High Court Cr.Misc. No.80242 of 2018(3) dt.05-02-2019 2/2 but injury were found to be caused by hard and blunt substance and the petitioners have clean antecedent.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) with two sureties of the like amount each in connection with Bidupur P.S.Case No. 157 of 2018 to the satisfaction of learned Additional Chief Judicial Magistrate- XIV, Vaishali at Hajipur, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
