2. The petitioner has prayed for bail in connection with Deo P.S. Case No. 47 of 2026 registered for the offence punishable under Section 103(1) read with Section 3(5) of the B.N.S., 2023.

3. The case of the prosecution, in short, is that the younger brother of the informant was killed in the village of his wife.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case.He also submits thatHe also submits that the relationship

On 16.02.2026, the wife of the deceased, Priyanka Kumari, and the mother-in-law of the deceased took the deceased to their village, and on 18.02.2026, the informant received the information that his brother has been killed. He also submits that the name of this petitioner has surfaced during the investigation in the confessional statement of the co-accused. Save and except the confessional statement of the co-accused, there is nothing against the petitioner. the relationship between the deceased and his wife was strained one. On 16.02.2026, the wife of the deceased, Priyanka Kumari, and the mother-in-law of the deceased took the deceased to their village, and on 18.02.

2026, the informant received the information that his brother has been killed. He also submits that the name of this petitioner has surfaced during the investigation in the confessional statement of the co-accused. Save and except the confessional statement of the co-accused, there is nothing against the petitioner. He further submits that similarly situated co-accused persons have been granted bail by this Court vide Cr. Misc. No. 32558 of 2026. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 20.02.2026.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Deo P.S. Case No. 47 of 2026.
