Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with G.R. No. 1034/2022 arising out of Rajnagar P.S. Case No. 170 of 2022 registered for the offence under Section 379 of the Indian Penal Code.

As per the prosecution story, on 07.06.2022 at about 11:45A.M., informant parked his Apache bike in the night and he went to sleep and when he woke up in the next morning, he saw that his motorcycle was not there. He tried to search his bike but he could not find the same.

Patna High Court CR. MISC. No.24309 of 2023(2) dt.19-05-2023 2/2 Learned counsel for the petitioner submits that the petitioner is in custody since 25.08.2022 and the petitioner is quite innocent and he has not committed any offence. Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.-I, Madhubani/concerned Court below in connection with G.R. No. 1034/2022 arising out of Rajnagar P.S. Case No. 170 of 2022.

The petitioner will visit Khajauli Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
