This application, for grant of anticipatory bail, arises out of Patahi Police Station Case No. 154 of 2016, disclosing offences under Sections 399, 402, 414, 411 of the Indian Penal Code and 25(1-b), a, 26, 35 of the Arms Act, 1959. Learned counsel for the petitioner has submitted that petitioner has not been named in the F.I.R. and merely on the basis of confessional statement of co-accused, against whom earlier mother of the petitioner had lodged a case bearing Pathahi P.S. Case No. 08 of 2014, name of this petitioner has falsely been surfaced in this case. The petitioner is of clean antecedent. Hence, the petitioner deserves the privilege of

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 8th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Patahi Police Station Case No. 154 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
