Petitioner is accused of offence punishable under section 47A of the Excise Act.
From the shop of the petitioner, country made liquor of different description and quantity were recovered. He, however, escaped when the raid was conducted.
Contention of the petitioner is that it was not recovered from his conscious possession. The seized articles actually do not belong to him.
Learned APP opposed the prayer for bail.
Looking to the materials on record, particularly, the seizure memo, enclosed along with the F.I.R., I am not inclined to
Patna High Court Cr.Misc. No.35503 of 2016 (2) dt.20-09-2016 2/2 privilege the petitioner with anticipatory bail. Prayer is, accordingly, rejected.
