Heard learned counsel for the parties concerned. 2.

The present writ application has been filed for a direction to the respondents to pay medical expenses to the tune of Rs. 2,57,818/- incurred by the petitioner in the treatment of his wife. The petitioner has retired from the post of Assistant Teacher of Rajkiya Prathmik Vidyalaya, Gaunaha, Lauriya Anchal, West Champaran.

Learned counsel for the petitioner submits that during pendency of this writ application, a sum of Rs. 50,000/- has been paid to the petitioner, however, the Deputy Secretary, vide his Memo no. 883 dated 28.03.2019, has returned the

Patna High Court CWJC No.7810 of 2019(6) dt.23-01-2024 2/2 proposal for entire payment with nine objections and directed the concerned District Education Officer to send the required documents after rectifying the errors. Accordingly, it is submitted that the writ application may be disposed with liberty to the petitioner to approach the District Education Officer, West Champaran and produce all the required documents for consideration of his claim.

Learned counsel for the State has got no objection in this regard.

Having regard to the facts and circumstances of the case and taking into account the nature of dispute, the present writ application is disposed with liberty to the petitioner to produce the original medical documents along with other documents demanded by the authority, within a period of one month from today and if the same is produced within time, the concerned authority shall examine the documents and shall take necessary steps for redressal of the grievance of the petitioner, in accordance with law.
