JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 29-06-2022 The petitioner, who is an accused in NDPS Case No. 05 of 2008/19 of 2000 arising out of Rajauli P.S. Case No. 42/2008, registered for the offences punishable under Section 307, 147, 148, 149, 186, 353, 379, 411, 120B of the Indian Penal Code, under Section 25(1-b)a/26/35 of the Arms Act, under Section 17 of C.L.A. Act, under Section 20/22 of the Narcotic Drugs and Psychotropic Substances Act and Section 33 of the Forest Act, has renewed his prayer for bail. His similar prayer was earlier rejected twice, firstly, by an order dated 17.12.2020 passed in Cr. Misc. No. 33144 of 2020 and subsequently by the order dated 27.10.2021 passed in Cr. Misc. No. 52649 of 2021.

Patna High Court CR. MISC. No.24386 of 2022(3) dt.29-06-2022 2/2 Learned counsel appearing on behalf of the petitioner attempted to convince this Court that since co-accused Suresh Paswan has been allowed regular bail by an order dated 22.09.2020 passed in Cr. Misc. No. 25112 of 2020, this Court may favorably consider the petitioner's prayer for bail. It is noted that the petitioner's prayer for bail was rejected earlier by order dated 27.10.2021 after noticing the order of this Court dated 22.09.2020 passed in Cr. Misc. No. 25112 of 2020. There being apparent distinguishable feature between the case of the present petitioner and the co-accused Suresh Paswan, I am not inclined to reconsider the petitioner's prayer for bail.

This application is accordingly rejected.
