JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and 25(1-B)a, 26, 35 of the Arms Act.

One cartridge is said to have been recovered from conscious possession of the petitioner when petitioner and others assembled to commit a crime.

Although, police instituted the case under Sections 399, 402 of the I.P.C. and the relevant provisions of Arms Act but considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner,

Patna High Court Cr.Misc. No.80198 of 2018(2) dt.17-01-2019 2/2 above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S. Case No. 464 of 2018.
