The petitioner seeks bail in Turkauliya Banjariya P.S. Case No. 590/2018, instituted for offences under Section(s) 392/120(B), 411 of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence, informant was going to attend meeting at Anjgari Mathwa Tola then near Phulwari of Ramniwas Singh three persons intercepted him and snatched the bag which he was carrying. The accused persons were addressing each other as Neyaz (petitioner), Tasir and Mainnuddin. At the same time one person namely Hari Om came there and said something to them and left. Thereafter the accused persons fled away after

Patna High Court Cr.Misc. No.80719 of 2018(2) dt.17-01-2019 2/2 snatching his mobile and cash. The villagers identified them as petitioner and others.

The police arrested the petitioner and prepared seizure-list in which it is mentioned that spice mobile and other articles including PAN Card and Voter Card etc of the informant was recovered from possession of this petitioner. Learned counsel for the petitioner has submitted that no T.I.P. of either of the petitioner or of the seized articles as mentioned in the seizure-list has been held in this case. Petitioner is in custody since 09.09.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya Banjariya P.S. Case No. 590/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
