Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Alauli P.S. Case No. 04 of 2023 registered for the offence under Section 302 read with Section 34 of the Indian Penal Code. Case of the prosecution in nut shell is that on 04.01.2023 at about 3:15 P.M. informant's brother along with his cousin brother was going to home from Khagaria on motorcyle. Mean while five accused persons on two motorcycles were standing on the way. When informant's brother asked them give way then accused persons fired indiscriminately upon him consequently he fell down on the ground and his cousin brother

Patna High Court CR. MISC. No.24043 of 2023(2) dt.18-05-2023 2/2 namely, Ranjan Yadav was standing there. On arrival of the villagers informant's brother was carried to Sadar Hospital, Khagaria from where he was referred to Begusarai for treatment where he died during the course of the treatment. The petitioner and other accused persons have brutally killed the deceased.

In view of the facts, as mentioned above, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer of bail of the petitioner is rejected herewith.
