The petitioner has approached this Court for issuance of direction to the respondent-authorities to reopen the shop of public distributing system vide License No.2 of 2011 which as per the petitioner was closed seven years ago in the Dhankutwa Primary Agriculture Cash Cooperative Ltd. (PACS), Sikata, District, West Champaran.

3. The learned counsel appearing for the State opposes the maintainability of the present writ application on account of the fact

Patna High Court CWJC No.6598 of 2025(2) dt.23-04-2025 2/2 that the petitioner has approached this Court belatedly without offering any explanation as to why the petitioner was sleeping over the matter for the last 7 years.

4. In paragraph No.4 of the writ application, the petitioner has himself contended as follows :- "4. That the short fact of this case is that there is a shop of the public distributing system vide LIC NO.2/11 in the Primary Agriculture Credit cooperative Ltd. (Paca) in the village Dhankutwa P.S. Bhalshar Block Sikata District West Chamapran earlier. This seven years ago this said shop was closed by the respondents authorities due to some reasons, there after the election of the same Pacs the another persons has been elected as a chairman by the members of the said Pacs and there after the demand of the reopen of the said shop has been produced before the respondent anchorites by the proceeding of the said PACS."

5. From the above statement made by the petitioner, it is clear that he has not even disclosed why his shop was closed seven years ago and neither anywhere in the writ application, the petitioner has given any explanation for coming to this Court after inordinate delay of 7 years.

6. In view of the above fact that the petitioner has approached this Court after inordinate delay of 7 years, without any explanation, the present writ application cannot be entertained and is thus dismissed.
