Mr. Manoj Kumar - 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 This is an application for grant of anticipatory bail in connection with Raniganj P.S. Case No. 252 of 2018, disclosing offences under Sections 363, 365, 366(A) of the Indian Penal Code.
Allegation against the petitioners is of kidnapping the minor daughter of the informant.
Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and they are ladies.
Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioners stating that the statement of girl recorded under Section 164 Cr.P.C. has supported the prosecution case.
Patna High Court Cr.Misc. No.80371 of 2018(3) dt.20-02-2019 2/2 Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners, rather they should surrender and make prayer for regular bail, which shall be considered on the basis of materials available on record, if possible, to be disposed of on the same day.
Accordingly, this application is dismissed.
