JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 31-08-2016 Heard Mr. Manoj Kumar Singh, the counsel for the petitioner and Mr. M. Dayal, APP for the State. This is repeat application seeking anticipatory bail in Agamkuan P.S. Case No. 211 of 2015 registered under Sections 304(B)/34 of the Indian Penal Code.
Along with another co-accuseds, the petitioner had moved this Court for anticipatory bail, which was considered and rejected vide order dated 19.01.2016 (Annexure-1). Again, such prayer is made before this Court on the ground that the petitioner is an infirm lady.
Learned Counsel for the State opposed the prayer and submitted that she is an accused of 304(B) of the I.P.C. Within seven years of marriage of the deceased, she was done to death in
Patna High Court Cr.Misc. No.35394 of 2016 (3) dt.31-08-2016 2/2 the matrimonial home. Her prayer for anticipatory bail was earlier considered and rejected.
Considering the submissions of the parties, I do not find any merit in this application, which is accordingly dismissed. (Kishore Kumar Mandal, J) rohit/- U T
