The petitioner seeks regular bail in connection with Pandaul Police Station Case No. 283 of 2019, registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The allegation, as per the First Information Report, is that the daughter of the informant was married to the son of the petitioner about 13 years back and it has been alleged that the informant got information on 15.11.2020 that his daughter has been killed by the petitioner and other co-accused persons, including the husband of the deceased and the dead body has been cremated secretly.

Learned Counsel for the petitioner submits that the

No.32627 of 2021(2) dt.17-12-2021 2/3 petitioner has not committed any offence in the manner alleged and no material has surfaced against the petitioner to connect her with the present offence. He further submits that the fatherin-law of the deceased has been granted bail by a co-ordinate Bench of this Court, vide orde, dated 22.12.2020, passed in Criminal Misc. No. 33389 of 2020. He next submits that the petitioner is in custody since 02.07.2020 and charge sheet has been submitted against the petitioner and as such, there is no likelihood that the petitioner will abscond and/or tamper with the evidence.

Regards being had to the submissions advanced on behalf of the parties concerned and taking into consideration the materials available on record and the fact that the father-in-law of the deceased has been granted bail by this Court, the petitioner is the mother-in-law of the deceased, charge sheet has already been submitted and the petitioner is in custody since 02.07.2020, I am inclined to grant regular bail to the petitioner. This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with
