JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-10-2023 Learned counsel for the petitioner submits that though in the progress report the case has been shown to have been dismissed, as no order has been generated and signed, the application cannot be said to have been dismissed. He has further submitted that though an order dated 12.08.2020 is shown to have been passed calling for the case diary, in fact, to his knowledge, no such order was passed and he had appeared for the first time in this case on 18.09.2020. He submits that in the present set of facts and circumstances he may be permitted to withdrawn this application with a liberty to the petitioner to seek regular bail before the court below.
