In this case, the petitioner is seeking anticipatory bail in connection with Sonepur P.S. Case No. 384 of 2018, registered for the offence punishable under Sections 341, 323, 324, 307, 326, 504, 379 of the Indian Penal Code. Allegation against the petitioner is to have caused the injury by Dabiya. On perusal of the case diary it appears that there is specific allegation against the petitioner and different persons have stated about the role of the petitioner in the alleged occurrence.
Learned counsel for the petitioner submits that there is case and counter case between the parties. There is delay of three days in lodging the FIR.
Patna High Court Cr.Misc. No.80751 of 2018(3) dt.19-02-2019 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court. (Shivaji Pandey, J) V.K.Pandey/- U T
