This is a petition for grant of anticipatory bail for offence under Sections 467, 468, 471, 420 and 406/34 of the Indian Penal Code.
The petitioner had obtained bank loan of rupees five lakh for repairing of the house. After sanction of loan, it revealed that the petitioners had mortgaged the same title deed with some other bank earlier for getting loan and only on the basis of a copy of the chirkut meant for receiving the original sale deed, the present loan was sanctioned. The manager of the bank is not an accused, who had sanctioned the loan without getting original title deed verified and only on the basis of the chirkut the loan has been sanctioned. The petitioners have already refunded the principal
Patna High Court Cr.Misc. No.38989 of 2016 (5) dt.06-04-2017 2/2 amount.
Considering the aforesaid fact, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Raxaul P.S. Case No. 125 of 2016 to the satisfaction of the Subdivisional Judicial Magistrate, Raxaul, at Motihari, East Champaran, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
