====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Excise Case No.103 of 2021, instituted for the offences under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 17.03.2021 and he is a person with clean antecedent, charge-sheet has been submitted in this case. The allegation is of recovery of 1400 litres of sprit from pick-up van and the petitioner is the owner-cum-driver of the pick-up van which was used for hire and as such, he was not aware what was kept in the van.

The learned A.P.P. for the State opposes the bail

Considering the fact that the petitioner is in custody since 17.03.2021 and he is a person with clean antecedent, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Excise Case No.103 of 2021.

The application stands allowed.
