ANJANA MISHRA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner being the owner of Om Mini Rice Mill, Chandan Nagar, Gulabbagh is apprehending his arrest in connection with Sadar P.S. Case No. 160 of 2016 registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.
It appears from the records of the case that out of Rs. 34, 80,420.03/-, the present petitioner, namely, Paras Kumar Jaiswal has already deposited Rs. 18,54,400/- with the State Food Corporation.
In view of the fact that the petitioner being only one
Patna High Court Cr.Misc. No.34025 of 2016 (3) dt.21-10-2016 2/2 of the partners and the liability is joint against his co-partner, namely, Sunil Jaiswal who is also facing a certificate proceedings, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 160 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
