The petitioner apprehends his arrest in Paliganj P.S. Case No. 136 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The petitioner is alleged to have assaulted Shatrughan Singh the brother of the informant with iron rod causing fracture injury on the hand.

Learned counsel for the petitioner submits that the witnesses have stated in para 7 and 8 of the case diary that there was some verbal altercation and the brother of the informant fell down in which he got injuries, but from perusal of the injury report as well as the statement of the informant and the victim it appears that the informant got three injuries out of which there

Patna High Court Cr.Misc. No.24167 of 2015 (3) dt.07-10-2015 2/2 was one fracture injury on the left hand.

Considering the facts aforesaid and the fact that on account of assault made by the petitioner fracture injury caused to the brother of the informant, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
